This is a draft policy pending review by our Nigerian counsel. It explains how to tell us about content on ratioafrica.com that you believe infringes your copyright, and how we respond. We operate under the Nigerian Copyright Act 2022, consistent with section 3 of our Terms and Conditions. We offer the notice-and-takedown process below, which follows the familiar DMCA structure, as the practical channel for reporting and resolving copyright complaints.
01Our approach to copyright
We respect the intellectual property of others and expect everyone who uses the Site to do the same. If we are satisfied that content we host infringes someone's copyright, we will remove or disable access to it. We may also take action under our Acceptable Use Policy against participants who post infringing material.
02How to report infringement
If you believe content on the Site infringes a copyright you own or are authorised to act for, send a written notice to our designated agent (see section 3). To be valid, your notice should include all of the following:
- your name, address, email, and telephone number;
- identification of the copyrighted work you say has been infringed;
- identification of the material you say is infringing, with enough detail for us to locate it, including the URL or page where it appears;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
- a statement that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf; and
- your physical or electronic signature.
03Designated agent
Send copyright notices to our designated agent:
Designated agent: [PLACEHOLDER, agent name to be confirmed]
Ratio Africa Limited
Address: [PLACEHOLDER, registered address to be confirmed]
Email: connect@ratioafrica.com
04What happens after a valid notice
When we receive a notice that we are satisfied is valid, we will remove or disable access to the material in question within a reasonable time. We will make a reasonable effort to notify the person who posted the material that we have acted, and to pass on a copy of the notice so they can respond.
05Submitting a counter-notice
If your material was removed and you believe that was a mistake, or that you have the right to post it, you may send a counter-notice to our designated agent. A counter-notice should include:
- your name, address, email, and telephone number;
- identification of the material that was removed and the location where it appeared before removal;
- a statement, made in good faith, that you believe the material was removed as a result of mistake or misidentification; and
- your physical or electronic signature.
On receiving a valid counter-notice, we may restore the material at our discretion, taking account of the rights of all parties and applicable law. We are not obliged to restore material where doing so would expose us or others to legal risk.
06Repeat infringers
We will, in appropriate circumstances, suspend or terminate the access of participants who repeatedly infringe the copyright of others. A pattern of valid notices against the same person may lead to removal from a cohort and its groups.
07Misuse of this process
Submitting a notice or counter-notice that you know to be false, or that misrepresents the facts, may expose you to liability under applicable law. Please use this process in good faith. If you are not sure whether content infringes your rights, consider seeking legal advice before sending a notice.
